Hastings Wrongful Death Attorneys Win Compensation

Count on Our Wrongful Death Lawyers in Hastings, MN, to Help

Our Hastings wrongful death lawyers understand how devastating it can be to be faced with the sudden, unexpected death of a loved one — especially if the death never would have happened except for someone else’s negligence or wrongful behavior. In addition to their overwhelming grief, survivors often must deal with the disruptions and financial problems from the loss of a family member’s income, anger at those whose negligence caused the death, and the desire to punish the responsible parties.

While no amount of money can make up for the loss of your love one, Minnesota provides a path to getting both justice and the compensation that will provide much-needed financial stability to help your family through this difficult period. This path is through filing a wrongful death lawsuit.

There may be cause for a wrongful death lawsuit when a family member is killed as a result of the negligence of another. Who Can File a Wrongful Death Claim?

State laws determine who can file a wrongful death claim and who is entitled to benefits. According to Minnesota statutes (section 573.02), a trustee appointed by the family or court system can file a claim on behalf of the surviving family members — the deceased’s surviving spouse, children, or parents. Eligible family members ask the court to allow a trustee to handle the case on the family’s behalf, and all family members who are eligible to receive damages must join together in a single claim. The administrator of the deceased’s estate may also file a wrongful death suit on behalf of the estate’s beneficiaries, and in some cases, other family members may be permitted to file a wrongful death lawsuit. Compensation is distributed to the surviving spouse and next of kin.

Wisconsin’s wrongful death statute (Wisconsin section 895.04) allows an action for wrongful death to be brought by the personal representative of the deceased person or certain members of the person’s family. Surviving family members who can file the wrongful death claim are, in order: the deceased’s spouse or domestic partner, children or grandchildren, parents, grandparents, and siblings.

Our Hastings wrongful death lawyers will make sure you are eligible to file and that filings are done correctly and in a timely manner. Be aware that there are statutes of limitation, time limits for filing a wrongful death case. According to Minnesota Statutes section 573.02, the family or other representative of the deceased person generally must file a lawsuit within three years from the date of the person’s death and the action must start within six years after the act causing the death. In Wisconsin, you generally have three years from the date of the accident to start a lawsuit for personal injury or wrongful death (Wisconsin section 893.54).

If you don’t file on time, the courts can refuse to hear your case, so call us today to get started.

Damages Our Wrongful Death Lawyers in Hastings, MN, May Recover

How Much is Compensation for Wrongful Death?
Juries tend to be sympathetic, and damage awards may be high when a wrongful death is involved, ranging from the hundreds of thousands to millions of dollars. However, the amount you may receive depends on the individual circumstances of your case and factors such as the degree of fault involved and the availability of insurance coverage and defendant assets. Minnesota law allows families to receive up to three types of compensation without limits:

  • Economic Damages – monetary economic losses, including funeral expenses, medical expenses, and the earnings and potential future earnings of the person had the death not occurred
  • Non-economic damages – for losses that do not have a specific monetary value but negatively impact your life, such as pain and suffering of the family, loss of companionship, loss of parental guidance, loss of assistance, companionship, and protection
  • Punitive damages – may be awarded in some rare cases. According to Minnesota law (Minnesota statute § 549.20), punitive damages may be awarded as a punishment against the at-fault party, applicable only when the defendant exhibited intentional disregard for the decedent’s safety and rights.

Wisconsin wrongful death law (Wisconsin statute § 895.043) places a $200,000 limit on the amount of punitive damages available.

Consideration may also be made for factors such as whether survivors were close relatives, such as a spouse or child, who depended on the deceased financially or for emotional support.

Wrongful Death Attorneys in Hastings, MN, Must Prove Negligence

Proving someone else’s negligence can be an essential component of a wrongful death claim. Proving negligence legally involves showing that…

  • the defendant owed a duty of care to the victim not to cause harm
  • they breached that duty by actions or failure to act
  • the breach caused the victim’s death
  • the plaintiff suffered damages as a result.

To win your case, our attorneys must be able to show by the preponderance of evidence gathered through investigations, interviews, and expert testimony that these elements exist. Sometimes, more than one party was negligent and contributed to the death. For example, if a defective product caused your loved one’s death, it is possible that the product manufacturer, the party who sold your loved one the product, and anyone who explained to your loved one how they should use the product were negligent. In some cases, an individual, organization, or company may be held liable for the actions of one of its employees or agents. Our Hastings wrongful death lawyers will determine all the parties that should be part of the claim and name them as defendants, as they all may have assets and insurance that can go toward meeting a judgment.

When the Wrongful Death is Intentional

Intentional torts are another type of civil wrong that can be the basis for a wrongful death claim. An intentional tort means that the civil wrong was committed on purpose instead of being the result of negligence or carelessness.

Common intentional torts that can lead to wrongful death claims include assault, battery, and false imprisonment. For an intentional tort to be the basis of a wrongful death claim, the person who committed the tort must have intended to injure the victim. For example, if someone assaults another person and the victim dies due to the injuries sustained in the assault, the assailant can be held liable for wrongful death.

When our Hastings wrongful death lawyers are representing you, we address only the civil aspect of the case and pursue a financial award against the defendant and their insurance company. Rather than attempting to seek jail time for the defendant, we seek a financial award that helps you and your family with the expenses and financial setbacks related to losing your loved one.

Hastings Wrongful Death Attorneys Answer FAQs

After losing a loved one to a wrongful death, family members are bound to have questions and concerns. Our Hastings wrongful death lawyers can answer most of these at your free consultation, but to get you started, here are answers to some of the most common questions we receive.

How long does it take to get a settlement?
The time it takes to settle each case is different, depending on the complexity and factors involved. If an agreement is reached through negotiations, you may get a settlement in a matter of months, while cases that go to trial can drag on for years. While we know you want to receive compensation as soon as possible, proving a wrongful death is highly complex and time-consuming, and our Hastings wrongful death attorneys need time to investigate, gather evidence, and to negotiate for the best settlement possible.

Will I have to go to court?
In most cases, wrongful death lawsuits are settled out of court, and the parties involved agree to a settlement amount through negotiations. If you do have to appear in court, our Hastings wrongful death lawyers will make sure you are thoroughly prepared.

What are common situations that lead to a wrongful death claim?
Wrongful deaths can occur in a wide range of situations, including car accidents, defective products, slip and fall accidents, and workplace accidents. Regardless of the cause, our Hastings wrongful death attorneys at Tyroler Leonard Injury Law will be there for you, helping you determine whether filing a lawsuit is the right course of action and guiding you through the process.
